By accessing or using Upsellity AI's services, you agree to be bound by these Terms, and if you disagree with any part, you may not access the Service. Upsellity AI is a Shopify app that provides AI-powered upselling and cross-selling solutions, including Progress bar functionality, Gift selection features, Smart product recommendations, Automated gift additions, Customizable offer rules, and Analytics and reporting tools. For Account Registration and Security, you must have a valid Shopify store, and installation requires administrative access, with you being responsible for maintaining the security of your credentials and notifying us of any unauthorized use. You must provide accurate and complete information and are responsible for all account activities. For Free Trial and Subscription, new users get a 14-day free trial requiring no credit card, which can be canceled at any time. Continued use after the trial requires a paid subscription based on store size, with all payments processed securely through Shopify, and subscriptions can be canceled at any time. Regarding Use of Service, you agree to use the Service only for legitimate business purposes, legal commercial activities, and purposes that comply with Shopify's terms. Prohibited activities include modifying or tampering with the Service, using it for illegal purposes, attempting to access other users' accounts, interfering with its operation, or copying/distributing any part without authorization. For Data and Privacy, we collect data necessary to provide and improve services, all of which complies with GDPR regulations and industry-standard security measures. Customer data is used only for providing and improving the Service; we do not sell customer data to third parties, and analytics data is used to improve service performance. Finally, for Service Performance and Availability, we strive to provide the highest level of service reliability, including maintaining optimal performance with minimal impact on store speed and performing regular maintenance, backed by 24/7 technical support. We aim for 99.9% uptime and will communicate scheduled maintenance in advance, reserving the right to modify or discontinue features with notice. T&C should be defined according to the specific needs and nature of each website. For example, a website offering products to customers in e-commerce transactions requires T&C that are different from the T&C of a website only providing information (like a blog, a landing page, and so on). T&C provide you as the website owner the ability to protect yourself from potential legal exposure, but this may differ from jurisdiction to jurisdiction, so make sure to receive local legal advice if you are trying to protect yourself from legal exposure.
